POPARCHIVE — Terms of Service

Before publishing: this is a first-pass draft, not a substitute for review by a lawyer licensed where you operate — especially before billing/Stripe goes live. Fill in the bracketed placeholders below (governing state, contact email) with your real details.

1. Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and PopArchive ("PopArchive," "we," "us," or "our") governing your access to and use of the PopArchive website and application (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, please don't use the Service.

2. What PopArchive Is

PopArchive is a personal collection-tracking tool for Funko Pop collectors. It lets you record items you own, track what you paid versus estimated current value using publicly available eBay listing data, and optionally save items you're considering buying to a Wishlist. PopArchive is not a marketplace — it does not buy, sell, hold, authenticate, insure, or ship any physical item.

3. Eligibility

You must be at least 13 years old to create a PopArchive account. The Service is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we've collected information from a child under 13, we will delete it.

4. Your Account

You're responsible for the accuracy of the information you provide when creating your account, for keeping your password and any two-factor authentication credentials secure, and for all activity that happens under your account. Let us know right away if you believe your account has been accessed without your permission.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to other users' accounts or data; scrape, automate, or make excessive/abusive requests against the Service or the third-party APIs it relies on (including eBay's); reverse-engineer or interfere with the Service's normal operation; or upload content you don't have the right to upload.

6. Your Content and Data

You retain ownership of the collection information you enter into PopArchive (item names, prices, notes, images you attach, and similar). By using the Service, you grant PopArchive a license to store, process, and display that information back to you as part of providing the Service. We don't sell your collection data, and we don't use it to train third-party AI models.

Items you remove go to Trash and are kept until you permanently delete them or request account deletion — see the Privacy Policy for how to request that.

7. Free Tier and Paid Plans

PopArchive currently offers a free tier with an item limit. We may introduce paid plans with additional features or higher/no limits in the future. If we do, separate billing terms (pricing, billing cycle, cancellation, and refund policy) will apply and will be presented to you before you're charged anything.

8. eBay Integration — Please Read Carefully

PopArchive is not affiliated with, endorsed by, or sponsored by eBay Inc. "eBay" and related marks are trademarks of eBay Inc. and are used here only to describe the integration below.

PopArchive uses eBay's public APIs to (a) search for and display eBay listing photos and pricing you can attach to items you own, and (b) show an "Estimated Value" for items on your shelf, calculated from recent eBay listing data. Estimated Value is informational only. It is not an appraisal, is not guaranteed to be accurate, and the actual amount you could buy or sell an item for on eBay or anywhere else may be significantly different. Don't rely on it for financial, insurance, tax, or investment decisions.

When you click a "Buy Now," "Buy on eBay," or similar link in PopArchive, you leave PopArchive and are taken to eBay's website to complete any purchase directly with eBay and the third-party seller. PopArchive is not a party to that transaction. Any issue with a purchase — payment, shipping, item condition, authenticity, refunds, or disputes — is between you, eBay, and the seller, and is governed entirely by eBay's own terms, policies, and dispute-resolution processes, not by PopArchive or these Terms.

Affiliate disclosure: PopArchive participates in the eBay Partner Network, an affiliate advertising program. As an eBay Partner, PopArchive may be compensated if you make a qualifying purchase after clicking a Buy Now / Buy on eBay link in the app — at no extra cost to you. You'll also see this noted directly next to those links in the app itself.

Funko Pop, Funko, and related product names and imagery belong to Funko, Inc. and/or the relevant sellers, and are used in listing data purely for identification purposes. PopArchive is not affiliated with or endorsed by Funko, Inc.

9. Intellectual Property

The PopArchive™ name, logo, and the Service's design, code, and branding (excluding your own content and any third-party trademarks or listing data referenced above) belong to PopArchive. You may not copy, reuse, or redistribute them without our permission. (PopArchive is the subject of a pending U.S. trademark application — not yet a registered mark, hence "™" rather than "®".)

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that data will never be lost — though we do take regular backups as a precaution.

11. Limitation of Liability

To the fullest extent permitted by law, PopArchive and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service — including anything arising from an eBay purchase made through a link in the app. To the extent any liability isn't excludable, it's limited to the amount (if any) you paid PopArchive in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold PopArchive harmless from any claim or demand, including reasonable legal fees, made by a third party arising from your misuse of the Service or your violation of these Terms.

13. Termination

You may stop using the Service and request deletion of your account at any time (see the Privacy Policy for how). We may suspend or terminate an account that violates these Terms, with notice where reasonably possible.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll make a reasonable effort to let you know (such as an in-app or email notice) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of [Your State/Country], without regard to conflict-of-law principles. [Optional: consider adding an arbitration clause and class-action waiver here with a lawyer's help — common for small SaaS apps, but the exact wording needs to hold up under your state's law.]
