POPRCHIVE — Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and PopArchive ("PopArchive," "we," "us," or "our") governing your access to and use of the PopArchive website and application (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, please don't use the Service.

2. What PopArchive Is

PopArchive is a collection-tracking tool for Funko Pop collectors. It lets you record items you own, track what you paid versus an estimated current value based on publicly available eBay listing data, save items you're considering buying to a Wishlist, and look up any Pop's estimated value with our free Value Check tool. PopArchive is not a marketplace — it does not buy, sell, hold, authenticate, insure, or ship any physical item.

3. Eligibility

You must be at least 13 years old to create a PopArchive account. The Service is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we've collected information from a child under 13, we will delete it. If you're under 18, you need a parent or guardian's permission to buy a paid subscription, and they accept these Terms on your behalf.

4. Your Account

You're responsible for the accuracy of the information you provide when creating your account, for keeping your password and any two-factor authentication credentials secure, and for all activity that happens under your account. Let us know right away if you believe your account has been accessed without your permission. PopArchive will never ask for your password or full card number by email.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to other users' accounts or data; scrape, automate, or make excessive/abusive requests against the Service (including the Value Check tool) or the third-party APIs it relies on (including eBay's); reverse-engineer or interfere with the Service's normal operation; knowingly submit false or misleading information to shared features such as the Pop database or Box Art; or upload content you don't have the right to upload.

6. Your Content and Data

You retain ownership of the collection information you enter into PopArchive (item names, prices, notes, photos you attach, and similar). By using the Service, you grant PopArchive a license to store, process, and display that information to you as part of providing the Service. We don't sell your collection data.

A few features share information beyond your own account. Here's exactly what, and what you control:

• Shared Pop database. When you scan a barcode or enter or confirm a Pop's details, the product information (such as name, number, series, variants, factory code, and UPC) may be added to PopArchive's shared database and shown to other users to help them identify the same Pop. Only these product facts are shared — never your prices, quantities, notes, or account details, and they're not shown with your name. You grant PopArchive a non-exclusive, worldwide, royalty-free, perpetual license to use this product information for that purpose, and it may remain in the database after your account is deleted.
• Public Pop pages (Value Check). PopArchive's free public pages (poparchive.club/value) list Pops by their product details only — name, box number, series, category, and variants — together with current eBay listings for that Pop. A Pop is only listed once its details have been confirmed through the shared Pop database, or at least two collectors have added it, or it's in PopArchive's own reference collection. These pages never show who owns a Pop, how many people own it, or anything from your account (your prices, quantities, notes, photos, or name). Box photos shown on these pages are PopArchive's own, never yours.
• Box Art photo sharing (opt-in). Only if you turn on Photo Sharing, box photos you take or upload may be reviewed and shown to other users as box art for the same Pop. You grant PopArchive a non-exclusive, worldwide, royalty-free license to display those photos for that purpose. You confirm you took the photo or have the right to share it. You can turn Photo Sharing off at any time, and you can ask support to remove photos you've already shared.
• Share My Collection. If you create a share link, anyone who has the link can view your shared collection (and its value, if you choose to show it). You can turn the link off or replace it at any time.
• Box photo autofill. When you use "Autofill from Box Photo," the photo you choose is sent to an AI service (Anthropic's Claude) to read the details printed on the box. We don't use your collection data to train AI models, and our AI provider doesn't use these photos to train its models under its commercial terms.

Items you remove go to Trash, where you can restore them for 7 days. After that they're permanently deleted automatically.

7. The Free Plan (Collector Account) and the 150-Item Limit

The free Collector Account plan lets you keep up to 150 active Pops on your shelf (Sold and Trashed items don't count) and includes value estimates, Wishlist, and Share My Collection. We may change the features or limits of the free plan in the future; if we do, we'll give you reasonable notice first.

If your collection is over 150 items when Curator Account access ends (for example, your trial ends without a subscription, or a subscription is cancelled), nothing is deleted. Your collection becomes read-only: you can still see everything, but you can't add, edit, or import until you subscribe again. At that point you can also choose to permanently delete your account and collection instead. We may occasionally email read-only accounts about reactivating; you can unsubscribe from those emails at any time.

8. Paid Subscription (Curator Account)

• Price. The Curator Account costs $2.99 per month or $29.99 per year, plus any applicable taxes. The price shown at checkout is the price you'll pay.
• Free trial. Every new account gets a free 7-day trial of the Curator Account's scanning and import/export tools. No card is required, and the trial does not turn into a paid subscription on its own — you're only charged if you choose to subscribe.
• Automatic renewal. Your subscription renews automatically at the end of each monthly or yearly period, and your payment method is charged the then-current price, until you cancel.
• Cancelling. You can cancel at any time using the Manage billing link (on the Pricing page). Cancelling stops future renewals; you keep Curator Account access until the end of the period you've already paid for.
• Refunds. Payments are non-refundable, and we don't provide refunds or credits for partially used periods, except where required by law. If you believe you were charged in error, contact support and we'll look into it.
• Price changes. If we change the price, we'll tell you at least 30 days in advance. The new price applies from your next renewal after that, and you can cancel before then if you don't want to continue.
• Payment processing. Payments are processed by Stripe. For some purchases, Stripe or one of its affiliates may act as the seller of record and handle sales tax, in which case their terms also apply to that purchase. PopArchive never sees or stores your full card details.
• Promotions. We may offer promotional codes or discounts from time to time. These have no cash value and may be subject to their own conditions.

9. Emails

We'll send you emails that are needed to run your account, such as email verification, password resets, a welcome email, trial and billing notices, and replies to support requests. Collecting tips and collection-value updates are sent only if you opt in, and Value Check new-listing alerts only if you request and confirm them. Every optional email includes an unsubscribe link.

10. eBay Integration — Please Read Carefully

PopArchive is not affiliated with, endorsed by, or sponsored by eBay Inc. "eBay" and related marks are trademarks of eBay Inc. and are used here only to describe the integration below.

PopArchive uses eBay's public APIs to (a) search for and display eBay listing photos and pricing you can attach to items you own, (b) show an "Estimated Value" for items on your shelf, calculated from recent eBay listing data, and (c) show current eBay listings, with the sellers' asking prices, on the free Value Check pages. Value Check pages don't calculate or suggest a value; listing details and prices come from eBay and its sellers and can change at any time. Estimated Value is informational only. It is not an appraisal, is not guaranteed to be accurate, and the actual amount you could buy or sell an item for on eBay or anywhere else may be significantly different. Don't rely on it for financial, insurance, tax, or investment decisions.

When you click a "Buy Now," "Buy on eBay," or similar link in PopArchive, you leave PopArchive and are taken to eBay's website to complete any purchase directly with eBay and the third-party seller. PopArchive is not a party to that transaction. Any issue with a purchase — payment, shipping, item condition, authenticity, refunds, or disputes — is between you, eBay, and the seller, and is governed entirely by eBay's own terms, policies, and dispute-resolution processes, not by PopArchive or these Terms.

Funko Pop, Funko, and related product names and imagery belong to Funko, Inc. and/or the relevant sellers, and are used in listing data purely for identification purposes. PopArchive is not affiliated with or endorsed by Funko, Inc.

11. Intellectual Property

The PopArchive™ name, logo, and the Service's design, code, and branding (excluding your own content and any third-party trademarks or listing data referenced above) belong to PopArchive. You may not copy, reuse, or redistribute them without our permission. (PopArchive is the subject of a pending U.S. trademark application — not yet a registered mark, hence "™" rather than "®".)

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that data will never be lost — though we do take regular backups as a precaution. Information in the shared Pop database and Box Art comes partly from other users and may contain mistakes.

13. Limitation of Liability

To the fullest extent permitted by law, PopArchive and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service — including anything arising from an eBay purchase made through a link in the app. To the extent any liability isn't excludable, it's limited to the amount (if any) you paid PopArchive in the 12 months before the claim.

14. Indemnification

You agree to indemnify and hold PopArchive harmless from any claim or demand, including reasonable legal fees, made by a third party arising from your misuse of the Service, content you upload or share, or your violation of these Terms.

15. Termination

You may stop using the Service and request deletion of your account at any time (see the Privacy Policy for how). If you have a subscription, cancel it first so you aren't charged again. We may suspend or terminate an account that violates these Terms, with notice where reasonably possible. If we ever decide to shut down the Service, we'll give you reasonable advance notice and a chance to export your collection.

16. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll make a reasonable effort to let you know (such as an in-app or email notice) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of PopArchive shall be subject to the exclusive jurisdiction of the state and federal courts located in Fort Bend County, Texas, or the nearest court of competent jurisdiction. By using PopArchive, you consent to the personal jurisdiction and venue of such courts.

Before initiating any legal proceeding, both parties agree to make a good-faith effort to resolve the dispute informally by contacting the other party and attempting to reach a mutually acceptable solution.
